Lienholder & Creditor Surplus Claims
Surplus funds are not always paid straight to the former owner. Subordinate lienholders — second mortgages, judgment creditors, certain assessment holders — may have a priority claim on the money that survives the foreclosure sale.
We research the lien position, confirm whether the claim is viable in that jurisdiction, and prepare the documentation the custodian will require.

- Lien priority controls. A claim behind other surviving interests may recover nothing.
- Some jurisdictions restrict surplus recovery to the former owner only.
