Mortgage Foreclosure Surplus Funds Recovery
When a home sells at a mortgage foreclosure auction for more than the amount owed, the money left over after the lender, costs and any senior liens are paid does not belong to the bank. In most states it belongs to the former owner — but it usually sits with the court, county or a court-appointed referee until someone files a claim for it.

Important to know
- Surplus is only created when the sale price exceeds what was owed plus allowed costs. Not every foreclosure produces one.
- Some courts require a petition and a hearing; where licensed counsel is required, we associate a local attorney.
